YAMATJI ELDER FIGHTS NDIS PROVIDER IN COURT, CALLS FOR FAMILY CONTROL

A Karratha woman says she has been fighting to regain control of her brother’s NDIS care after alleging he was wrongfully removed from her home by a Service Provider in 2025.

Jane Tittums says she witnessed her brother, a respected Aboriginal elder living with dementia, being taken from her care last year. The matter is now before the courts.

Ms Tittums says she was later removed as her brother’s nominee, and the Service Provider attempted to put Ms Tittums' brother under the Public Advocate/Trustee through the State Administrative Tribunal, despite holding legal guardianship and power of attorney.

She also alleges she was accused of elder abuse by the provider, claims she denies.

Ms Tittums says her brother receives more than half a million dollars in annual NDIS funding, but claims the funds are not enough, and that one-on-one support has not been approved.

She says without additional funding, she may be forced to relocate her brother to an aged care facility outside the Pilbara.

Her lawyer, Donald Betts, says the case raises broader concerns about oversight and cultural understanding within the NDIS system, particularly in regional and remote communities.

The matter remains before the court.
